Abstract: The aim of the present presentation is to give a brief introduction into special aspects of patenting polymorphs and their prosecution. To confer a solid state modification of a known substance novelty, it is necessary to make it distinguishable from known solid state modifications of this substance. Concerning inventive step aspects of the German and European approach will be presented. Some examples will be furnished, that show how critical the point of assortment of analytical methods and data are and how they can affect prosecution and challenging of the patent.

“How identical is identity? X-ray patterns and patenting”

Abstract: X-ray powder patterns of solids are considered as unambiguous fingerprints of a crystalline solid to prove identity. 2θ-angles of the signals and their intensities contain different information, for which the significance is discussed in the context of polymorphs, pseudopolymorphs, isomorphic, and amorphous systems. The importance, complement character, and reliability of single crystal structure determination are bestowed. Examples from patent literature will be presented to demonstrate the relevance to disclose the experimental conditions and to avoid controversial and unclear situations.
