We will accompany you from the original idea via the application up to the granting of your property rights. In case of conflict, we will be on your side and protect your property rights or enforce your rights against third parties on your behalf. We work on a national and frequently on an international basis, using German and English as the languages of communication.
We will work out together with you a legally sustainable concept and quickly prepare the relevant application documents within the scope of your acquiring property rights. We will submit these to the Patent Office on your behalf as quickly as possible and subsequently take care of the legal and technical correspondence with the Office during the granting or examination procedures.
We will first conduct an assessment of any interfering rights of your competitors from a property rights perspective. In case of sufficiently great prospects of success, we will deal with these on your behalf (objection, action for annulment, action for cancellation, contradiction, etc.). Alternatively, we will work out with you some legally admissible workarounds or support you during licensing negotiations.
In case of infringement disputes, we will advise you with regard to attack and defence, issue infringement opinions and, together with lawyers, institute infringement proceedings before the competent courts.
We will represent you before the German Patent and Trademark Office, the European Patent Office (EPO), the Office for Harmonisation in the Internal Market (OHIM), the World Intellectual Property Organisation (WIPO), the German Federal Patent Court, and, in case of nullity cases and appeal cases, the German Federal Court of Justice. In cases of property rights infringements, we will work together with lawyers that are accredited by the competent German civil courts. In case of property rights issues abroad, we will fall back on our network of foreign colleagues.
